Whereas:
(1) On 28 October 2022, European Registration Office B.V. submitted an application to the European Chemicals Agency (‘the Agency’) in accordance with Article 43(1) of Regulation (EU) No 528/2012 for Union authorisation of a single biocidal product named ‘ERO MN’ of product-types 3 and 4, as described in Annex V to that Regulation, providing written confirmation that the competent authority of Belgium had agreed to evaluate the application. The application was recorded under case number BC-CL081294-38 in the Register for Biocidal Products.
(2) ‘ERO MN’ contains Alkyl (C12-16) dimethylbenzyl ammonium chloride and glutaraldehyde as active substances included in the Union list of approved active substances referred to in Article 9(2) of Regulation (EU) No 528/2012 for product-types 3 and 4.
(3) On 7 March 2025, the evaluating competent authority submitted, in accordance with Article 44(1) of Regulation
(EU) No 528/2012, an assessment report and the conclusions of its evaluation to the Agency.
(4) On 2 October 2025, the Agency submitted to the Commission its opinion(2), the draft summary of the biocidal product characteristics (‘SPC’) of ‘ERO MN’ and the final assessment report on the single biocidal product, in accordance with Article 44(3) of Regulation (EU) No 528/2012.
(5) In its opinion, the Agency concludes that ‘ERO MN’ is a single biocidal product within the meaning of Article 3(1), point (r), of Regulation (EU) No 528/2012, that it is eligible for Union authorisation in accordance with Article 42(1) of that Regulation and that, subject to compliance with the draft summary of the SPC, it meets the conditions laid down in Article 19(1) of that Regulation.
(6) On 20 October 2025, the Agency transmitted to the Commission the draft SPC in all the official languages of the Union in accordance with Article 44(4) of Regulation (EU) No 528/2012.
(7) The Commission concurs with the opinion of the Agency and considers it therefore appropriate to grant a Union authorisation for the single biocidal product ‘ERO MN’.

(8) Glutaraldehyde was identified as a candidate for substitution by Commission Implementing Regulation
(EU) 2015/1759(3), which established that the substance meets the conditions set out in Article 10(1) of Regulation
(EU) No 528/2012. Therefore, the evaluating competent authority performed a comparative assessment of ‘ERO MN’ in accordance with Article 23(1) of Regulation (EU) No 528/2012.
(9) ‘ERO MN’ is intended to be used for the following applications: Use 1 – hard, non-porous surface disinfection in animal housing (product-type 3), applied by spraying after prior cleaning; Use 2 – hard, non-porous surface disinfection of animal transportation vehicles, inside and outside, including tyres (product-type 3), applied by spraying after prior cleaning; and Use 3 – hard, non-porous surface disinfection in food and feed areas (product-type
4), applied by spraying after prior cleaning.
(10) The comparative assessment has demonstrated that suitable alternatives exist for Use 1 and Use 3. Therefore, in accordance with Article 23(7) of Regulation (EU) No 528/2012, the authorisation for ‘ERO MN’ should be granted for a maximum period of four years. Only Use 2 will be eligible for authorisation renewal.
(11) The measures provided for in this Regulation are in accordance with the opinion of the Standing Committee on Biocidal Products,
HAS ADOPTED THIS REGULATION:
Article 1 A Union authorisation with authorisation number EU-0035833-0000 is granted to European Registration Office B.V. for the making available on the market and use of the single biocidal product ‘ERO MN’ in accordance with the summary of the biocidal product characteristics set out in the Annex.
The Union authorisation is valid from 29 September 2026 until 31 August 2030.
Article 2 This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

Detailed description:
Thoroughly clean and rinse the surface. Remove any excess water from the surface before disinfection.
For bacteria, yeasts and viruses: dilute the product to 0,6 % v/v. To prepare a 0,6 % product dilution, dilute 6 ml of the disinfectant product in 1L of water.
Spraying: Pour the diluted product into the reservoir of a spraying device. Be sure to completely wet the surfaces by spraying the product onto the surface to be disinfected (150 ml/m2) at 10°C minimum. Keep the surfaces wet throughout the contact time.
After application: after the contact time, rinse disinfected surfaces with water.

4.1.2. Use-specific risk mitigation measures Without prejudice to the application by employers of Council Directive 98/24/EC and other Union legislation in the area of health and safety at work, the following risk mitigation measures shall be applied:
— The product is strictly intended for professional use in a professional environment, therefore non- professionals and the general public are not present in areas that must be disinfected using this product.

Make sure that new gloves are changed at the beginning of each workday.
— Wear eye and face protection meeting the requirements of European standard EN 16321 or equivalent during mixing & loading. — Wear respiratory protective equipment (RPE) protecting against gases and particles with an assigned protection factor of at least 20. At least a powered air purifying respirator with helmet/hood/mask (TH1/TM1), or a half/full mask with gas filter is required (filter type (code letter, colour) and the EN standards concerning the [device/devices/filter type/device and filter type/devices and filter type] to be specified by the authorisation holder within the product information according to the national regulations) during mixing & loading, application, and post-application phase (including rinsing step).
— Use an impermeable coverall during mixing & loading and spraying application. Wear a protective coverall which is impermeable for the biocidal product (coverall material to be specified by the authorisation holder within the product information).
— Only use in empty animal housing. — Treated rooms / buildings and the danger area shall be labelled with a warning sign. — Ventilate treated areas thoroughly until surface has dried before re-entry. — Rinse with drinking water the surface after biocidal product application with high pressure cleaner (water pressure max 130 bar).
— For the small equipment that cannot be cleaned with high pressure, after applying the biocidal product, rinse treated surfaces with drinking water by immersion and dry with a mop or towel through mechanical action.
— Livestock must not re-enter areas until surfaces have been thoroughly rinsed and dried. — Do not disinfect livestock housing and animal transport vehicle on the same day.

Spraying: Pour the diluted product into the reservoir of a spray. Be sure to completely wet the surfaces by spraying the product onto the surface to be disinfected (150 ml/m2) at 20-25°C. Make sure the surfaces are completely wet. Keep the surfaces wet throughout the contact time.
After application: After the contact time, rinse disinfected surfaces with water.

5. GENERAL DIRECTIONS FOR USE(1)
5.1. Instructions for use — See use-specific instructions for use. — Inform the authorisation holder if the treatment is ineffective. — The active substance in the product is known to cause development of resistance in some organisms (e.g., the product may become less effective if used frequently). The product should be used with care and in accordance with the instructions for use, in order to limit the development of resistance.

IF SWALLOWED: Immediately rinse mouth. Give something to drink, if exposed person is able to swallow. Do NOT induce vomiting. Call 112/ambulance for medical assistance.
IF ON SKIN: Immediately wash skin with plenty of water. Thereafter take off all contaminated clothing and wash it before reuse. Continue to wash the skin with water for 15 minutes. Call a POISON CENTER or a doctor.
IF IN EYES: Immediately rinse with water for several minutes. Remove contact lenses, if present and easy to do.
Continue rinsing for at least 15 minutes. Call 112/ambulance for medical assistance.
Information to Healthcare personnel/doctor:
The eyes should also be rinsed repeatedly on the way to the doctor in case of eye exposure to alkaline chemicals (pH>11), amines and acids like acetic acid, formic acid or propionic acid.
IF INHALED: Move to fresh air and keep at rest in a position comfortable for breathing. If symptoms occur: Call 112/ ambulance for medical assistance. If no symptoms occur: Call a POISON CENTRE or a doctor.

Initiate life support measures if needed, thereafter call a POISON CENTRE.
Emergency measures to protect the environment:
Do not allow to flow into sewers or open water. Contain released substance, store into suitable containers. If possible remove by using absorbent material.
