L.-33004/99 सी.जी.-डी.एल.-अ.-16092026-276236 CG-DxLx-xEG-I1D6H0x9x2x0 26-276236 xxxGIDExxx असाधारण EXTRAORDINARY भाग II—खण् ड 3—उप-खण्ड (ii) PART II—Section 3—Sub-section (ii) प्राजधकार स ेप्रकाजित PUBLISHED BY AUTHORITY स.ं 4889] नई दिल्ली, बुधिार, जसतम्ब र 16, 2026/भाद्र 25, 1948 No. 4889] NEW DELHI, WEDNESDAY, SEPTEMBER 16, 2026/BHADRA 25, 1948 गहृ मत्रं ालय अजधसचू ना नई दिल्ली, 16 जसतम्ब र, 2026 का.आ. 5080(अ).— जिजधजिरुद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) (जिसे इसमें इसके पश्चात ् उक्त अजधजनयम कहा गया ह)ै व्यजियों और संगमों के कजतपय जिजधजिरूद्ध दियाकलापों के अजधक प्रभािी जनिारण और आतंकिािी दियाकलापों से जनपटने के जलए और उससे संबंजधत जिषयों के जलए उपबंध करने हते ु अजधजनयजमत दकया गया ह;ै और, उक्त अजधजनयम की धारा 2 की उपधारा (1) के खंड (ड) के अनुसार ‘आतंकिािी संगठन’ से उक्त अजधजनयम की पहली अनुसूची में सूचीबद्ध संगठन या इस प्रकार सूचीबद्ध संगठन के रूप में समान नाम के अधीन दियािील सगं ठन अजभप्रेत ह;ै और, उक्त अजधजनयम की पहली अनुसूची म ेंऐसे आतंकिािी संगठनों की सूची अंतर्ििष्ट ह;ै और, ‘िहजाि भट्टी नेटिकि (एसबीएन)’ एक ऐसा संगठन ह ैजिसका उद्देश्य िेि के भोले-भाले युिाओं और स्ट्थानीय अपराजधयों को सजम्मजलत करके सीमा पार से हजथयारों, जिस्ट्फोटकों ि निीले पिाथों की तस्ट्करी तथा आतंकिािी दियाकलापों के माध्यम स ेिेि की लोकतांजत्रक व्यिस्ट्था, सांप्रिाजयक सौहािि और आतं ररक सरु क्षा के जलए एक गंभीर खतरा पैिा करना ह;ै और, िहजाि भट्टी नेटिकि (एसबीएन) के सिस्ट्यों के जिरुद्ध जिजिध अजधकाररताओं के अतं गित जिजभन्न अजधजनयमों की जनम्नजलजखत धाराओं के अधीन जिजधजिरुद्ध और आतंकिािी दियाकलापों म ेंउनकी संजलप्तता के जलए कई आपराजधक मामल े सम्यक रूप से ििि दकए गए ह,ैं यथा : - 7086 GI/2026 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART II—SEC. 3(ii)]

(i). भारतीय न्याय संजहता, 2023 (2023 का 45) - धारा 3(5), 6(2), 52, 55, 61, 61(2), 78, 103, 109, 109(1), 111, 113, 113(3), 125, 148, 152, 324(4), 353, और 353(1)(ख) के अधीन;

(ii). आयुध अजधजनयम, 1959 अजधजनयम (1959 का 54) - धारा 3, 4, 25, 25(8), 27, 54, और 59 के अधीन;

(iii). जिजधजिरुद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 (1967 का 37) - धारा 13, 15, 16, 17, 18, 18-ख, 20, 23, 25, 35, 39, 40, 43, और 43-ङ के अधीन;

(iv). जिस्ट्फोटक पिाथि अजधजनयम, 1908 (1908 का 6) - धारा 3, 4, और 5 के अधीन;

(v). जिस्ट्फोटक अजधजनयम, 1884 (1884 का 4) - धारा 4, 5, और 9(ख)(1)(ख) के अधीन;

(vi). सूचना प्रौद्योजगकी अजधजनयम, 2000 (2000 का 21) - धारा 66(च), 66-ग, और 66-घ के अधीन;

(vii). दिल्ली संपजि जिरूपण जनिारण अजधजनयम, 2007 (2009 का 1) - धारा 3 के अधीन;

(viii). िासकीय गुप्त बात अजधजनयम, 1923 (1923 का 19) - धारा 3 के अधीन;

(ix). आप्रिास और जििेजियों जिषयक अजधजनयम, 2025 (2025 का 13) - धारा 24 के अधीन। और, ‘िाहिाि भट्टी नेटिकि (एसबीएन)’ भोले-भाले युिाओं को जिजभन्न प्रलोभन िेकर कट्टरपथं ी बनाने, उन्ह ें िेि जिरोधी दियाकलापों के जलए प्रेररत करने तथा अन्य प्रजतबंजधत संगठनों और नामजनर्ििि इकाइयों के साथ िस्ट्ु संजध करके राष्ट्र- जिरोधी कृत्यों के जलए संसाधन िुटाने में अन्तििजलत ह;ै और, ‘िाहिाि भट्टी नेटिकि (एसबीएन)’ जिजभन्न जडजिटल सचं ार माध्यमों का उपयोग करके भड़काऊ संिेिों को प्रसाररत करने और लोक व्यिस्ट्था को भगं करन े िाली हहसं क दियाकलापों के माध्यम स ेआतकं िाि को बढािा िे रहा है, िो िेि की अखंडता के जलए एक गभं ीर चुनौती ह;ै और, केन् द्रीय सरकार का यह जिश् िास ह ैदक ‘िहजाि भट्टी नेटिकि (एसबीएन)’ आतंकिाि म ेंसंजलप् त ह ैऔर उसन े भारत में आतंकिाि के जिजभन्न कृत्यों में भाग जलया है;

अतः, अब, केंद्रीय सरकार, जिजधजिरूद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 की धारा 35 की उपधारा (1) के खंड (क) द्वारा प्रिि िजक्तयों का प्रयोग करते हुए, उक्त अजधजनयम की पहली अनुसूची में जनम्नजलजखत और संिोधन करती ह,ै अथाित ् : - उक्त अजधजनयम की पहली अनसु ूची में िम संखयांक 45 और उससे संबंजधत प्रजिजियों के पश्चात् , जनम्नजलजखत िम संखयांक और प्रजिजि अंतःस्ट्थाजपत की िाएगी, अथाित ् : - "46. िहजाि भट्टी नेटिकि (एसबीएन)"। [फा. सं. 11034/04/2026/CT-I] राकेि राठी, संयुक्त सजचि रटप्पण: जिजधजिरुद्ध दियाकलाप (जनिारण) अजधजनयम, 1967 की पहली अनुसूची, अजधसूचना संखयांक का.आ. 4391 (अ), तारीख 10 अक्तूबर, 2024 द्वारा अंजतम बार संिोजधत की गई थी। MINISTRY OF HOME AFFAIRS

NOTIFICATION New Delhi, the 16th September, 2026 S.O. 5080(E).— Whereas, the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) (hereinafter referred to as the said Act) has been enacted to provide for more effective prevention of certain unlawful activities of individuals and associations and for dealing with terrorist activities and for matters connected therewith;[भाग II—खण् ड 3(ii)] भारत का रािपत्र : असाधारण 3

And whereas, as per clause (m) of sub-section (1) of section 2 of the said Act, 'terrorist organisation' means an organisation listed in the First Schedule to the said Act or an organisation operating under the same name as an organisation so listed;

And whereas, the First Schedule to the said Act contains the list of such terrorist organisations;

And whereas, ‘Shahzad Bhatti Network (SBN)' is an organisation whose objective is to involve gullible youth and local criminals to smuggle arms, explosives, and narcotics from across the border, and through terrorist activities, pose a serious threat to the democratic system, communal harmony, and internal security of the country;

And whereas, several criminal cases have been duly registered against the cadres of Shahzad Bhatti Network (SBN) across multiple jurisdictions for their involvement in unlawful and terrorist activities, invoking the following sections of various Acts, namely: -

(i). the Bharatiya Nyaya Sanhita, 2023 (45 of 2023) - under sections 3(5), 6(2), 52, 55, 61, 61(2), 78, 103, 109, 109(1), 111, 113, 113(3), 125, 148, 152, 324(4), 353, and 353(1)(b);

(ii). the Arms Act, 1959 (54 of 1959) - under sections 3, 4, 25, 25(8), 27, 54, and 59;

(iii). the Unlawful Activities (Prevention) Act, 1967 (37 of 1967) - under sections 13, 15, 16, 17, 18, 18-B, 20, 23, 25, 35, 39, 40, 43, and 43-E;

(iv). the Explosive Substances Act, 1908 (6 of 1908) - under sections 3, 4, and 5;

(v). the Explosives Act, 1884 (4 of 1884) - under sections 4, 5, and 9(b)(1)(b);

(vi). the Information Technology Act, 2000 (21 of 2000) - under sections 66(F), 66-C, and 66-D;

(vii). the Delhi Prevention of Defacement of Property Act, 2007 (1 of 2009) - under section 3;

(viii). the Official Secrets Act, 1923 (19 of 1923) - under section 3;

(ix). the Immigration and Foreigners Act, 2025 (13 of 2025) - under section 24;

And whereas, the 'Shahzad Bhatti Network (SBN)' is involved in radicalising gullible youth by offering various allurements, motivating them for anti-national activities, and mobilising resources for anti- national acts in collusion with other banned organisations and designated entities;

And whereas, the 'Shahzad Bhatti Network (SBN)' is promoting terrorism through violent activities that disrupt public order and by using various digital communication platforms to disseminate provocative messages, posing a serious challenge to the integrity of the nation;

And whereas, the Central Government believes that ‘Shahzad Bhatti Network (SBN)' is involved in terrorism and has participated in various acts of terrorism in India;

Now, therefore, in exercise of the powers conferred by clause (a) of sub-section (1) of section 35 of the Unlawful Activities (Prevention) Act, 1967 (37 of 1967), the Central Government hereby makes the following further amendments in the First Schedule to the said Act, namely: - In the First Schedule to the said Act, after serial number 45 and the entries relating thereto, the following serial number and entries shall be inserted, namely: - "46. Shahzad Bhatti Network (SBN)".
