बीईई/एसएण् डएल/ डब्ल्यूएम/06/22-23, तारीख 23 िनिरी, द्वारा प्रकाजित दकया गया था जिसमें ऐसे सभी व् यजयय से, जिनकी उससे प्रभाजित होने की संभािना थी उक्त अजधसूचना के रािपत्र म ें प्रकािन की तारीख से तीस ददन की जिजनर्दष्ा ट अिजध के भीतर कक्षेप और सुझाि कमंजत्रत दकए गए थ;े और उक्त प्रारूप जिजनयम की प्रजतयां िनता को 23 िनिरी, 2023 को उपलब् ध करा दी गई थं;

और उक्त प्रारूप जिजनयम के संबंध में उपयुाक् त अिजध के भीतर कक्षेप और सुझाि प्रा्‍ त ुएए ह । और इस संबंध म ेंप्रा्‍ त सुझाि पर जिचार कर जलया गया ह । अत: अब, ब् यरू ो, केंद्रीय सरकार के पूिाानुमोदन से, ऊिाा संरक्षण अजधजनयम, 2001 (2001 का 52) की धारा 13 की उपधारा (2) के खंड (ढ) और धारा 14 के खडं (घ) के साथ पठित धारा 58 की उपधारा (2) के खंड (i) द्वारा प्रदत् त िजयय का प्रयोग करते ुएए, जनम्नजलजखत जिजनयम बनाता ह,। अथाात् :-

1. संजक्षप्त नाम और प्रारंभ - (1) इन जिजनयम का संजक्ष्‍ त नाम ऊिा ा दक्षता ब्यरू ो (िशशिगं मिीन के लेबल पर उनके संप्रदिान की जिजिजियां और रीजत), जिजनयम, 2023 ह । 6907 GI/2023 (1)2 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(2) ये रािपत्र म ेंइनके प्रकािन की तारीख को प्रिृत् त ह गे

2. पठरभाषा:- (1) इन जिजनयम में, िब तक दक संदभ ासे अन्यथा अपेजक्षत न हो,- (क) "अजधजनयम" स ेऊिाा सरं क्षण अजधजनयम, 2001 (2001 का 52) अजभप्रेत ह;। (ख) "प्ररूप" से इन जिजनयम के साथ कोई प्ररूप अजभप्रेत ह;। (ग) "लेबल" स े दकसी भी जलजखत, मुदद्रत, जचजननत, मुद्रांदकत या रेखा जचत्रीय सामग्री अजभप्रेत ह ।िो िाशिंग मिीन पर जचपकाई गई ह ।या उस पर ददखाई दे रही ह;। (घ) "लेबल अिजध" से अजधजनयम की धारा 14 के खंड (क) के अधीन केन् द्रीय सरकार द्वारा अजधसूजचत ऊिाा जनष्प ादन मानक के अधीन प्रजत चक्र ऊिाा उपभोग प्रजत दकलोग्राम की जिजधमान् यता अिजध अजभप्रेत ह:। परंतु यदद लेबल जिजधमान् यता अिजध की समाजप्त की समय-सीमा तक, अजधजनयम की धारा 14(क) के अधीन नए जिद्युत मानक को अजधसूजचत नहं दकया िाता ह,। जिद्यमान मानक को तब तक जिजधमान् य समझा िाएगा िब तक दक केन् द्रीय सरकार द्वारा इसके जलए नए मान अजधसूजचत नहं दकए िाते;

(ड.) "अनुज्ञापत्रधारी" स े एक व्यजय या अजभकरण अजभप्रेत ह । जिसे जिजनयम 7 के अधीन लबे ल जचपकान े की अनुज्ञा दी गई ह;। (च) "अनुसूची" से इन जिजनयम से उपाबद्ध अनुसूची अजभप्रेत ह;। (छ) "स्ट्टार रेटटंग या स्ट्टार स्ट्तर" से अजधजनयम की धारा 14 के खंड (क) के अधीन केन् द्रीय सरकार द्वारा अजधसूजचत प्रजत चक्र ऊिा ा उपभोग के कधार पर िाशिंग मिीन के लेबल पर संप्रदर्िात ऊिाा दक्षता का ग्रडे ह । एक स्ट्टार के अंतराल म ेंउपलब्ध स्ट्टार कम से कम एक और अजधकतम पांच के मध्य अजभप्रेत ह । (ि) दकसी िाशिंग मिीन के बाबत "व्यापारी या जिक्रेता" से एक ऐसा व्यजय अजभप्रेत ह । िो िाशिंग मिीन को बेचता या जितठरत करता ह । और इसमें दकु ानदार, व्यापारी, जनमााता और अनुज्ञापत्रधारी सजममजलत ह । जिन्ह ें ऐसी िाशिगं मिीन पर लेबल जचपकाने की अनुज्ञा दी गई ह । (झ) "िशशिंग मिीन" से अजधजनयम की धारा 14 के खंड (ख) के अधीन अजधसूचना में जिजनर्दष्ा ट एक उपकरण अजभप्रेत ह;।

(2) उन िब् द और पद के, िो इसमें प्रयुय ह । और पठरभाजषत नहं ह,। दकन् तु अजधजनयम में पठरभाजषत ह,। िही अथ ा ह गे िो अजधजनयम म ेंह ।

3. लबे ल पर सप्रं दर्िता की िान े िाली जिजिजियां- (1) प्रत्येक िाशिंग मिीन पर जनम्नजलजखत जिजिजियां उसके लेबल पर संप्रदर्िात की िाएंगी अथाात्:- (क) स्ट्टार स्ट्तर; (ख) ऊिाा दक्षता ब्यरू ो का लोगो; (ग) साजधत्र का नाम;

(घ) िाशिंग मिीन का प्रकार; (ड.) ब्ांड या बनाना; (च) मशडल और जिजनमााण या कयात िष;ा (छ) भार क्षमता; (ि) पानी का उपभोग; (झ) यूजनक लेबल श्ृंखला कोड; और (ञ) लेबल अिजध.

(2) लेबल का जडजाइन, रंग, ककार और जिषय-िस्ट् तु इन जिजनयम से उपाबद्ध अनुसूची म ेंयथाजिजनर्दष्ा ट होगी[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 3

4. लबे ल सप्रं दर्िता करन ेकी समय-सीमा —

(1) स्ट्िज। छछक स े अजनिाय ा व्यिस्ट्था तक पारगमन - जिजनयम 3 में जिजनर्दष्ा ट सभी जिजिजिय िाला एक लेबल इन जिजनयम के प्रिृत् त होने की तारीख से छह मास की अिजध के भीतर प्रत्येक िाशिगं मिीन पर सभी जििरण िाला एक लेबल संप्रदर्िात दकया िाएगा

(2) अजनिाय ा ऊिा ा जनष्प ादन मानक का पनु रीक्षण- अजधजनयम की धारा 14 के खंड (क) के अधीन केन् द्रीय सरकार द्वारा अजधसूजचत पुनरीजक्षत जिद्युत जनष्प ादन मानक के प्रारंभ होन ेपर, प्रत्येक अनुज्ञापत्रधारी या व्यापारी या जिक्रेता- (क) िाशिंग मिीन का उत्पादन जपछले ऊिाा जनष्प ादन मानक के अनुसार नहं करेगा;

(ख) पुनरीजक्षत ऊिाा जनष्प ादन मानक के साथ तुल् यकालन करते ुएए पनु रीजक्षत स्ट्टार स्ट्तर और लेबल अिजध और िाशिंग मिीन का जिजनमााण िषा संप्रदर्िात दकया िाएगा; परन् त ु सुचारू पारगमन के जलए जिजनमााता पनु रीजक्षत ऊिाा जनष्प ादन मानक के साथ ऐसे प्रारंभ की तारीख से दो मास या उससे पहले उत् पाद का उत् पादन या कयात करेगा (ग) व् यिहाठरय , खुदरा व् यौहाठर क की िागरूकता, उनकी जिक्षा के साथ साथ उपभोक्त ा क की जिक्षा के जलए अपेजक्षत प्रचार सजहत प्रारंजभक कदम सुजनयोजित ह और कारािाई तीन मास पहले की िाए

5. लबे ल सप्रं दर्िता करन ेकी रीजत -

(1) जबक्री के स्ट् थान पर प्रत्येक िाशिंग मिीन पर जनमन जलजखत रीजत से लेबल जचपकाया िाएगा अथाात:् - (क) लेबल प्रत्येक साजधत्र के सामन े की ओर मिबूती स े चस्ट् पा होना चाजहए और ि।सा दक जिजनयम 3 के उप- जिजनयम (2) म ें जिजनर्दष्ा ट ह,। लेबल कसानी स े ददखाई दने ा चाजहए और अनुज्ञापत्रधारी यह सुजनजित करेगा दक लेबल प्रत्येक रजिस्ट् रीकृत यूजनट या मशडल पर जबक्री के समय ददखाई दे और लेबल को यूजनट या मशडल के प।केशिंग बशक्स पर मुदद्रत या चस्ट् पा दकया िाएगा; और (ख) लेबल स्ट्िय ंजचपकने िाली सामग्री का होगा अनुसूची द्वारा अपेजक्षत अंकन, सुपाठ्य, अजमट और ठटकाऊ होगी

(2) िो यूजनट प्रदिान के जलए नहं ह,। उन पर भी लेबल को मुदद्रत या किरण के बाहरी जहस्ट्से पर जचपकाया िाए और यह लेबल यूजनट या मशडल से िडु ा होना चाजहए, िब यूजनट या मशडल को इसकी प।केशिंग स े हटाया िाएगा या लेबल को ग्राहक या उपयोगकताा को ददए गए दस्ट्तािेज का एक जहस्ट्से के रूप में सजममजलत दकया िाएगा

6. लबे ल सप्रं दर्िता करन े की अनज्ञु ा - (1) ब्यूरो स े पूि ा अनज्ञु ा प्राप्त दकए जबना दकसी िाशिंग मिीन पर कोई स्ट्टार लेबल नहं लगाया िाएगा

(2) कंपनी रजिस्ट् रीकरण - ब्यूरो की अनुज्ञा प्राप्त करने के प्रयोिन के जलए, प्रत्येक ब्ांड प्ररूप 1 - (क) म ें यथाजनर्दष्ा ट प्रथक रूप से रजिस्ट् रीकृत दकया िाएगा, जिसमें एक लाख रुपए की लेबल प्रजतभूजत फीस होगी, िो संदाय के दकसी भी स्ट् िीकाया इल क्े र ाजनक मोड द्वारा देय ह:। परंत ु लघु उद्योग के मामल े म ेंलबे ल प्रजतभूजत फीस केिल पच्चीस हिार रुपए होगी;

(3) मशडल रजिस्ट् रीकरण- उप-जिजनयम (2) के अधीन अनज्ञु ा के प्रत्येक किेदन के साथ जनमन जलजखत ह ग े- (क) प्रजत मशडल दो हिार रुपए की किेदन फीस, िो संदाय के दकसी भी इल क्े र शजनक मोड द्वारा देय ह;। और (ख) संदाय के इलेक्रशजनक मोड द्वारा देय एक लाख रुपए की लेबल सुरक्षा फीस:

परंत ु लघु उद्योग के मामल े म ेंलबे ल सुरक्षा फीस केिल पच्चीस हिार रुपए होगी; और (ग) प्ररूप-1 – (ख) म ेंजिजनर्दष्ा ट दस्ट् तािेि

7. अनज्ञु ा प्रदान करना. -(1) जिजनयम 6 के अधीन एक किेदन प्राप्त होने पर और समाधान होन े के पश् चात् की सभी अपेक्षा क का अनुपालन दकया गया ह,। ब्यूरो, घरेल ू उपकरण म ें स्ट्टार लेबशलगं का प्रसार अपने म।नअु ल ददिा (ब्यरू ो का मानक और लेबशलंग पर पठरचालन म।नअु ल) में जिजनर्दिा अिजध के भीतर कर सकेगा ऐसी प्राजप्त, पर अनुदान की तारीख, जिजनयम 8 में यथाजनर्दष्ा ट ऐसे जनबंधन और ितों के अधीन,- (क) ब्ांड को प्ररूप 2- (क) या इलेक्रशजनक रूप म ेंरजिस्ट् रीकृत कर सकेगा; तथा4 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4] (ख) प्ररूप 2- (ख) या इलेक्रशजनक रूप में िाशिगं मिीन पर लेबल लगान े की अनुज्ञा प्रदान कर सकेगा

(2) ब्यूरो प्ररूप 3 में जिजनर्दष्ा ट एक रजिस्ट्टर बनायगे ा और उसमें अनुज्ञापत्रधारी का नाम दिा करेगा

(3) उपजिजनयम (1) के अधीन दी गई अनुज्ञा उस अिजध के जलए जिजधमान् य होगी, जिसके जलए धारा 14 के खंड (क) के अधीन केन् द्रीय सरकार द्वारा अजधसूजचत जिद्युत उपभोग मानक द्वारा जिजनर्दष्ा ट स्ट्टार स्ट्तर प्रिृत् त ह ।

(4) स्ट्टार रेटटंग योिना के पुनरीक्षण के मामले में, अनुज्ञा के निीनीकरण के जलए किेदन अनज्ञु ापत्रधारी द्वारा एक मास के जलए दकया िाएगा दकेंतु इसकी समाजप्त के पहले नहं दकया िाएगा और ऊिाा दक्षता ब्यूरो, नई ददल्ली के पक्ष म ें इलेक्रशजनक मोड में एक हिार रुपए की फीस के साथ देय होगा परंत,ु स्ट्टार रेटटंग योिना के जिस्ट्तार के मामल े में, एक हिार रुपए की उय निीनीकरण फीस से छूट दी िाएगी

(5) जिजधमान् यता अिजध की समाजप्त के पश् चात् दकसी भी किेदन का निीनीकरण नहं दकया िाएगा, ऐसी जस्ट्थजत में अनुज्ञापत्रधारी नया किेदन करेगा

(6) उपजिजनयम (4) के अधीन निीनीकरण के जलए किेदन प्राप्त होने पर और समाधान होने के पश् चात् दक सभी अजनिायाता क का अनुपालन दकया िाता ह,। ब्यूरो, ऐसी प्राजप्त की तारीख स े एक मास की अिजध के भीतर, प्ररूप 2 - (ख) में अनज्ञु ा का निीनीकरण कर सकेगा

(7) ऐसा अनुज्ञापत्रधारी िो उस तारीख स े िाशिंग मिीन के जिद्यमान मशडल पर लेबल जचपकाने के जलए अनुज्ञा चाहता ह,। जिस तारीख से पुनरीजक्षत स्ट्टार स्ट्तर प्रिृत् त होता ह,। िह प्ररूप IV के अनुसार घोषणा प्रस्ट्त ुत करेगा;

(8) अनुज्ञापत्रधारी नए जसरे से लेबल लगान े के जलए अनज्ञु ा लने े का प्रयास करेगा, यदद िाशिंग मिीन के नए मशडल पुनरीजक्षत स्ट्टार स्ट्तर के साथ तुल् यकालन दकया िाना ह,। और ऐसी अनुज्ञा के जलए किेदन पुनरीजक्षत स्ट्टार स्ट्तर के प्रिृत् त होने के छह मास पहले दकया िाएगा

8. लबे ल पर जिजिजिय को सप्रं दर्िात करन े के जलए जनबधं न और ित:ं- प्रत्येक अनुज्ञापत्रधारी, जिक्रेता या व्यापारी लेबल पर जिजिजियां संप्रदर्िता करने में जनम्नजलजखत जनबंधन और ितों का पालन करेगा, अथाात््ः - (क) िाशिंग मिीन के लेबल पर संप्रदर्िात स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) के अधीन अजधसूजचत ऊिा ा उपभोग मानक के अनरूु प होगा;

(ख) लेबल केिल िाशिगं मिीन के ऐसे मशडल पर जचपकाया िाएगा जिसके जलए अनज्ञु ा दी गई ह।; (ग) अनुज्ञापत्रधारी अपनी लागत पर लेबल को िाशिंग मिीन पर जचपकाएगा; (घ) िाशिंग मिीन के लेबल पर संप्रदर्िात स्ट् टार लेबल सभी समय अनुरजक्षत रखा िाएगा;

(ड.) जिजनयम 9 में यथाजिजनर्दष्ा ट लबे ल फीस का संदाय करेगा; (च) लेबलीकृत उपस्ट्कर के उत्पादन के ब्यौर से अंतर्िाि जिजिजियां और जित्तीय िषा की प्रत्येक जतमाही के कगामी समापन मास के भीतर प्रत्येक जतमाही के जलए देय उद्भूत फीस ब्यूरो को प्रस्ट्तुत की िाएगी;

(छ) प्रत्येक िषा अप्र।ल मास के 30िें ददन तक अपन े लेबल िाले उत्पाद के जिक्रय के जलए जनययु प्राजधकृत जितरक , व् यौहाठरय , खुदरा व् यौहाठरय और जिक्रेता क की एक अद्यतन सूची ब्यूरो को प्रस्ट्तुत की िाएगी; और (ि) ऐसे अन्य जनबधं न और ितों का अनुपालन दकया िाएगा जिन्ह ें ब्यरू ो घरेल ू उपकरण के जलए िारी मानक और लेबशलगं पर ब्यरू ो के प्रचालन म।नुअल म ेंजनजहत जनबंधन सजहत जिर्नाददि करेगा

9. लबे ल फीस: - (1) प्रत्येक अनुज्ञापत्रधारी ब्यूरो को िाशिगं मिीन पर इस प्रकार जचपकाए गए लेबल पर तीस रुपए लेबल फीस का संदाय करेगा

(2) उपजिजनयम (1) के अधीन जिजनर्दष्ा ट लेबल फीस प्रत्येक जित्तीय िषा की अंजतम तारीख स ेएक मास के भीतर िार्षाक रूप से संदाय की िाएगी्ः परन्त ु इस प्रकार जिजनर्दष्ा ट अिजध के भीतर लेबल फीस का संदाय करने में विफल रहने पर जिजनयम 6 के उपजिजनयम (3) के खडं (ख) के अधीन ब्यरू ो लेबल प्रजतभूजत फीस उस पर दस प्रजतित की दर स े ब्याि सजहत संदत्त िोध रकम िसलू कर सकेगा और यदद संदाय की अंजतम तारीख के एक िषा के भीतर लेबशलगं फीस की कुल रकम की[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 5 िसूली नहं की िाती ह,। तो ब्यूरो अनुज्ञापत्रधारी को ददए गए सभी लेबल को रद क कर सकेगा और समाचार पत्र म ें व् यजतक्रम के रूप म ेंअनुज्ञापत्रधारी का नाम प्रकाजित कर सकेगा

10. लबे ल प्रजतभजू त फीस का प्रजतदाय्ः - जिजनयम 9 के उपजिजनयम (2) के परंतुक के अधीन, अनुज्ञापत्रधारी िाशिंग मिीन का जिजनमााण बंद करन ेपर लेबल प्रजतभूजत फीस के संदाय का हकदार होगा

11. ब्यरू ो द्वारा सत्यापन- (1) ब्यूरो या इसके अजभजहत अजभकरण या तो स्ट्ित: या इनके द्वारा प्राप्त जिकायत के कधार पर, यह सुजनजित करन े के जलए सत्यापन कर सकेगा दक िाशिंग मिीन स्ट्टार स्ट्तर और इसके लेबल पर संप्रदर्िात अन्य जििरण के अनुरूप ह ।और यह अनुज्ञा के अन्य जनबंधन और ितों का अनुपालन करती ह ।

(2) सभी परीक्षण में धलु ाई जनष्प ादन, खंगालन े का जनष्प ादन, ऊिाा उपभोग, पानी का उपभोग और िल जनष्कषाण जनष्प ादन (अिजिि िल सामग्री) सजममजलत ह ।

(3) सत्यापन के प्रयोिन के जलए, ब्यूरो या उसके अजभजहत अजभकरण द्वारा, ि।सा िह उजचत समझ,े यादजृ छछक रूप स े जिजनमााण सुजिधा, गोदाम या ठरटेल कउटलेट से नमून े जलए िाएंगे

(4) उपजिजनयम (1) के अधीन जिकायत जमलन े पर ब् यरू ो राष्र ीय परीक्षण और अिं ाकन प्रयोगिाला प्रत् यायन बोड ा द्वारा जिजधित मान् यता प्रा्‍ त दकसी स्ट्ि तंत्र परीक्षण प्रयोगिाला में िाशिंग मिीन की चुनौती िांच कराएगा, - (क) ब्यूरो इस तरह के परीक्षण करने के जलए प्ररूप 5 म ें अनुज्ञापत्रधारी को नोठटस िारी करेगा और जिकायतकता ा को, नमूना लागत, परीक्षण, पठरिहन और ब्यूरो के साथ अन्य प्रासंजगक खचों स े संबंजधत ऐस े खचा, ऐसे समय के भीतर, ि।सा दक ब्यूरो द्वारा रेठटड दकया िा सकता ह,। िमा करने के जलए कहा िाएगा (ख) यदद चुनौती परीक्षण के अधीन जलया गया नमनू ा विफल हो िाता ह ।तो नमूने की लागत, नमनू े के पठरिहन और परीक्षण फीस के सभी खचों की प्रजतपूर्त ा अनुज्ञापत्रधारी द्वारा ब्यूरो को की िाएगी और ब्यूरो जिकायतकता ा को पूिोय खचा िापस कर दगे ा; और (ग) िहां उपकरण चनु ौती परीक्षण में सफल हो िाता ह । तो जिकायतकताा द्वारा िमा दकए गए खचा को िब्त कर जलया िाएगा

(5) िहां, उप-जिजनयम (1) के अधीन प्राप्त जिकायत पर, यदद अनज्ञु ापत्रधारी उप-जिजनयम (3) में जिजनर्दष्ा ट इस तरह के खचा को ऐसे समय के भीतर िमा करने म ेंअसफल रहता ह ।तो ब्यूरो- (क) उप-जिजनयम (3) में संदर्भात िाशिंग मिीन के सत्यापन को चुनौती परीक्षण द्वारा िारी रखेगा; और (ख) जिजनयम 6 के अधीन प्राप्त किेदन की प्रदक्रया को तब तक स्ट्थजगत रखा िाएगा िब तक दक इस तरह के व्यय को िमा नहं कर देता

(6) यदद चेक परीक्षण के जलए चुना गया िशशिंग मिीन का नमूना चेक परीक्षण या चनु ौती परीक्षण के दौरान असफल हो िाता ह,। तो अनुज्ञापत्रधारी को दसू रे चेक परीक्षण के जलए एक और अिसर ददया िाएगा और स्ट्ितंत्र परीक्षण में, पहल े परीक्षण में उपयोग की गई िाशिंग मिीन की दोगुनी मात्रा के साथ दसू रा परीक्षण अनुज्ञापत्रधारी की लागत पर उस प्रयोगिाला में करेगा िो उस प्रयोगिाला से अलग हो िहां पहला िांच परीक्षण दकया गया था और िो परीक्षण और िांच प्रयोगिाला क के जलए राष्ट्रीय प्रत्यायन बोडा (एनएबीएल) द्वारा जिजधित मान्यता प्राप्त होगी ब्यूरो उप-जिजनयम (3) में संदर्भात चुनौती परीक्षण या उप-जिजनयम (4) में संदर्भात दसू रे परीक्षण और नमनू े की खरीद और परीक्षण के जलए दकए िाने िाले खचों को देखने के जलए प्ररूप 5 में अनुज्ञापत्रधारी को सूजचत करेगा

(7) यदद दसू रा परीक्षण असफल हो िाता ह,। ब्यूरो, - (क) सभी राज्य अजभजहत अजभकरण को सूचना के अधीन प्ररूप 6 में अनुज्ञापत्रधारी को जनदेि दगे ा दक अनुज्ञापत्रधारी दो मास की अिजध के भीतर, -6 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(i) िाशिंग मिीन के लेबल पर संप्रदर्िात स्ट्टार स्ट्तर में सुधार करेगा या परीक्षण के दौरान पाई गई त्रुठटय और कजमय को दरू करेगा;

(ii) ब्यूरो के जनदिे का पालन करने के जलए बािार से सभी स्ट्टशक िापस लेगा; और

(iii) जिज्ञापन सामग्री पर संप्रदर्िात जिजिजिय म ें पठरितान करेगा; (ख) ऊिाा दक्षता ब् यरू ो उपभोया क के लाभ के जलए, दकसी भी राष्ट्रीय या प्रादेजिक द।जनक समाचार पत्र में दकसी भी अनुज्ञापत्रधारी, ब्ांड नाम, मशडल नाम या मशडल नंबर, लोगो और अन्य जिजनदेि का नाम और दकसी भी इलेक्रशजनक या दकसी अन्य रीजत से प्रकाजित करेगा, िो िह दो मास के भीतर िीक समझे;

(ग) ऊिाा दक्षता ब् यरू ो संबंजधत राज्य अजभजहत अजभकरण को ऊिाा सरं क्षण अजधजनयम की धारा 27 के अधीन अनुज्ञापत्रधारी और व् यापारी के जिरूद्ध न् यायजनणायन कारािाई िुरू करने के जलए सूजचत करेगा

(8) अनज्ञु ापत्रधारी उप-जिजनयम (7) में जिजनर्दष्ा ट दो मास की अिजध के समापन के दस ददन के भीतर - (क) जनदेि के अनुपालन म ेंकी गई कारािाई के संबंध म ेंप्ररूप VII में अनुपालन ठरपोट ाब्यूरो को भेिेगा; और (ख) यदद खंड (क) में जिजनर्दष्ा ट अनुपालन ठरपोटा जिजनर्दष्ा ट अिजध के भीतर दकसी भी जनदेि का अनुपालन दकए जबना प्राप्त होती ह । या प्राप्त नहं होती ह । तो इसे िारी दकए गए जनदिे का अनुपालन नहं माना िाएगा और इस किय के कदेि ब्यूरो द्वारा पाठरत दकया िाएगा

2. यह अनज्ञु ा जनमन जलजखत के अधीन ह-। (क) िाशिंग मिीन के लेबल पर संप्रदर्िात स्ट् टार स्ट् तर अजधजनयम की धारा 14 के खंड (क) और पिू ोय जिजनबंधन में उपबंजधत जनबंधन और ितों के अधीन अजधसूजचत िाशिगं मिीन के जलए ऊिाा उपभोग मानक के अनरूु प होगा;

(ख) िाशिंग मिीन के केिल ऐसे मशडल पर लेबल जचपकाना जिसके जलए अनज्ञु ा दी गई ह;। (ग) अनुज्ञापत्रधारी की लागत पर िाशिंग मिीन पर लेबल जचपकाया और शप्रंट दकया िाएगा या प।केशिंग पर जचपकाया िाएगा; (घ) अनुज्ञापत्रधारी यह सुजनजित करेगा दक िाशिंग मिीन पर संप्रदर्िात स्ट् टार लेिल हर समय अनरु जक्षत रखा िाएगा;

(ड.) अनुज्ञापत्रधारी ब्यूरो द्वारा यथाजिजनर्दष्ा ट लेबल फीस का संदाय करेगा; (च) अनुज्ञापत्रधारी जित्तीय िषा की प्रत्येक जतमाही के अंत में कगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौर का एक जिजिजियां ब्यूरो को प्रस्ट्ततु करेगा िही ब्यौरे ब्यूरो को एक स्ट्िचाजलत प्रणाली के माध्यम से भी प्रस्ट्ततु दकए िाएगं े;

(छ) अनुज्ञापत्रधारी िाशिंग मिीन के ऐसे अन्य जिजिजियां उपलब्ध कराएगा ि।सा और िब ब्यरू ो चाहगे ा, जिसके जलए अनुज्ञा दी गई ह ।

2. यह अनज्ञु ा इस िता के अध् यधीन ह ।दक - (क) िाशिंग मिीन के लेबल पर संप्रदर्िात स्ट् टार लेबल अजधजनयम की धारा 14 के खंड (क) और पूिोय जिजनबंधन में उपबंजधत दकए गए जनबंधन और ितों के अधीन अजधसूजचत िाशिंग मिीन के जलए ऊिाा उपभोग मानक के अनुरूप होगा;

(ख) िाशिंग मिीन के केिल ऐसे मशडल पर लेबल जचपकाया िाएगा जिसके जलए अनुज्ञा दी गई ह।; (ग) अनुज्ञापत्रधारी की लागत पर िाशिंग मिीन पर लेबल को मुदद्रत या जचपकाया िाएगा; (घ) अनुज्ञापत्रधारी यह सुजनजित करेगा दक िाशिंग मिीन पर संप्रदर्िात स्ट् टार स्ट् तर सभी समय अनरु जक्षत रखा िाएगा;

(ड.) अनज्ञु ापत्रधारी प्रजत लेबल तीस रुपए की लेबल फीस का संदाय करेगा; (च) अनुज्ञापत्रधारी जित्तीय िषा की प्रत्येक जतमाही के अंत में कगामी मास के भीतर प्रत्येक जतमाही के जलए लेबलीकृत उपस्ट्कर के उत्पादन के ब् यौर का एक जिजिजियां ब्यूरो को प्रस्ट्तुत करेगा िही ब्यौरे ब्यरू ो को एक स्ट्िचाजलत प्रणाली के माध्यम से भी प्रस्ट्ततु दकए िाएंगे िही ब्यौरे एक स्ट्िचाजलत प्रणाली के माध्यम से ब्यूरो को प्रस्ट्ततु दकए िाएंगे;

(छ) अनुज्ञापत्रधारी िाशिगं मिीन के ऐसे अन्य जिजिजियां उपलब्ध कराएगा ि।सा और िब ब् यरू ो चाहगे ा, जिसके जलए अनुज्ञा दी गई ह ।

(i) उपरोय जिजनर्दष्ा ट तारीख पर चुनौती परीक्षण/ दूसरा परीक्षण देखन े के जलए दकसी अजधकारी को नामजनर्दष्ा ट अजधकारी के रूप म,ें नाम, पदनाम और हस्ट्ताक्षर (मूल रूप म)ें उपदर्िता करत े ुएए प्राजधकरण पत्र के साथ नामजनर्दष्ा ट करें (पत्र कंपनी के प्राजधकृत हस्ट्ताक्षरकताा द्वारा सम यक रूप से हस्ट्ताक्षठरत और मुहर सजहत होगा)

NOTIFICATION New Delhi, the 31st October, 2023 F.No. BEE/S&L/WM/06/22-23.—Whereas the draft regulation namely, the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulations, 2023, were published vide

notification number BEE/S&L/WM/06/22-23, on dated 23rd January, Extraordinary, Gazette of India, part III ,

Section 4 as required under sub-section (1) of section 58 of the Energy Conservation Act, 2001 (52 of 2001 ), inviting objection & suggestion & from persons likely to be affected thereby within the specified period of thirty days from the date of publication of the said notification in the Official Gazette;

And whereas, Gazette copies of the said draft regulation were made available to the public on 23rd January, 2023;

And whereas, objections and suggestions have been received with respect to the said draft regulation within the period aforesaid;

And whereas, the suggestions received in this regard have been taken into consideration;28 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

Now, therefore, in exercise of the powers conferred by clause (i) of sub-section (2) of section 58 read with clause (n) of sub-section (2) of section 13 and clause (d) of section 14 of the Energy Conservation Act, 2001 (52 of

2001), the Bureau, with the previous approval of the Central Government, hereby makes the following regulations,

namely:-

1. Short title and commencement. - (1) These regulations may be called the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine), Regulations, 2023.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Definition . - (1) In these regulations, unless the context otherwise requires,--

(a) “Act” means the Energy Conservation Act, 2001(52 of 2001);

(b) “Form” means a form appended to these regulations;

(c) “label” means any written, printed, marked, stamped or graphic matter affixed to, or appearing upon the Washing Machine;

(d) “label period” means the validity period of per-cycle energy consumption per kg under energy performance standards notified by the Central Government under clause (a) of section 14 of the Act:

Provided that if, by the ending timeline of the label validity period, the new energy performance standards under clause (a) of section 14 of the Act are not notified, the existing standards shall deemed to be valid until new values for the Same are notified by the Central Government;

(e) “permitee” means a person or agency to whom permission has been granted to affix label under regulation 7;

(f) “Schedule” means the Schedule annexed to these regulations;

(g) “Star rating or star level” means the grade of energy efficiency displayed on the label of the washing machine based on energy consumption per cycle notified by the Central Government under clause (a) of section 14 of the Act. and the available stars are between a minimum of one and a maximum of five shown in one star interval.

(h) “trader or seller” in relation to any washing machine means a person who sells or distributes such washing machine and includes shopkeeper, trader, manufacturer and permittee who has been given permission to affix label on such washing machine;

(i) “Washing Machine” means an appliance as specified in the notification under clause (b) of section 14 of the Act;

(2) Words and expressions used herein but defined in the Act, shall have meanings assigned to them in the Act.

3. Particulars to be displayed on label. - (1) On every washing machine, the following particulars shall be displayed on its label, namely: -

(a) Star level;

(b) logo of the Bureau of Energy Efficiency;

(c) name of appliance;

(d) type of washing machine;

(e) Brand or make;

(f) Model number and year of manufacturing or import;

(g) load capacity;

(h) water consumption;

(i) unique label series code; and

(j) label period.

(2) The design, colour, size and content of label shall be as specified in the Schedule annexed to these regulations.[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 29

4. Time limit for display of labels.—

(1) Transition from Voluntary to Mandatory regime.- A label containing all the particulars specified in regulation 3 shall be displayed on every washing machine within a period of six months from the date of coming into force of these regulations.

(2) Revision of Mandatory Energy performance standards.- On and from commencement of revised energy performance standards notified by the Central Government under clause (a) of section 14 of the Act, every permittee or trader or seller,-

(a) shall not produce the washing machine with the previous energy performance standards;

(b) the washing machine shall display revised star level and label period with the revised energy consumption standard and the manufacturing year of the washing machine in synchronization with revised energy

performance standards: and provided that for smooth transition, manufacturer shall produce or import the product two months in advance from the date of such commencement with the revised energy performance standards.

(c) all preparatory steps including awareness of the dealers, retailers, requisite publicity for their education as well as for the education of the consumers are well planned and action taken three months in advance.

5. Manner of display of label. -

(1) There shall be label on every washing machine which shall displayed at the point of sale and such label shall be affixed on washing machine in the following manner, namely:-

(a) The label shall be firmly affixed at the front side of each appliance and should be easily visible as referred in sub-regulation (2) of regulation 3 and the permittee shall ensure that the label appears on every registered unit or model at point of sale and the label shall also be printed or pasted on the packaging box of the unit or model; and

(b) The label shall be of self – adhesive material. The markings required by the schedule shall be legible, indelible and durable.

(2) For units not on display, the label may be printed or pasted to the exterior to the casing and this label may be attached to the unit or model when the unit or model is removed from its packaging or the label shall be included as a part of the documentation given to the customer or user.

6. Permission for display of label.- (1) No star label shall be affixed on a washing machine without obtaining the prior permission of the Bureau.

(2) Company registration.- For the purposes of obtaining permission of the Bureau under sub-regulation

(1), an application for registration shall be made for every brand separately as specified in Form I (A), and accompanied by a label security deposit of one lakh rupee payable by acceptable electronic mode of

payment:

Provided that in case of small scale industry, the label security fee shall be twenty five thousand rupees only.

(3) Model registration.- Every application of the permittee under sub-regulation (2) shall be accompanied by—

(a) an application fee of two thousand rupees per model, payable by electronic mode of payment; and

(b) a label security fee of one lakh rupees, payable by electronic mode of payment:

Provided that in case of small scale industry label security fee shall be only twenty -five thousand thousand rupees; and

(c) documents specified in Form I (B).

7. Grant of permission.- (1) On receipt of an application under regulation 6 and after being satisfied that all requirements therein are complied with, the Bureau may, within a period as specified in DISHA (Bureau’s Operation Manual on Standards and Labelling) subject to such terms and conditions as specified in regulation 8, –

(a) register the brand in Form II-(A) in electronic form; and

(b) grant permission for affixing label on washing machine in Form II (B) in electronic form.

(2) The Bureau shall maintain a register in Form III and enter the name of the permittee therein.

(3) The permission so granted under sub-regulation (1) shall be valid for such period till the star level specified by the energy consumption standard as notified by the Central Government under clause (a) of section 14 of the Act.30 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(4) In case of revision of star rating plan, an application for renewal of permission shall be made by the permittee not later than one month before its expiry and shall be accompanied by a fee of rupees one thousand payable in electronic mode in favour of the Bureau of Energy Efficiency, New Delhi:

Provided that in case of extension of star rating plan, the said renewal fee of rupees one thousand shall be exempted.

(5) No application shall be renewed after expiry of validity period, in which case the permittee shall make a fresh application.

(6) On receipt of application for renewal under sub-regulation (4) and after being satisfied that all requirements are complied with, the Bureau may, within a period of one month from the date of such receipt, renew permission in Form II B.

(7) The permittee who seeks permission for continuance to affix label on the existing model of the washing machine from the date from which the revised star level comes into force, shall submit only a declaration in Form IV.

(8) The permittee shall seek permission to affix label afresh, if new model of the washing machine is planned to be launched to synchronise with the revised star level and application for such permission may be made six months in advance of coming into force of the revised star level.

8. Terms and conditions for display of particulars on label. - Every permittee, trader and seller shall,-

(a) comply with the energy performance standards for washing machine notified by the Central Government under clause (a) of section 14 of the Act;

(b) affix label only on such model of washing machine for which permission has been granted;

(c) print and affix label on washing machine at the cost of permittee;

(d) ensure that the star level displayed on the label of washing machine shall be maintained at all time;

(e) pay the label fee as specified in regulation 9;

(f) furnish to the Bureau a statement containing details of production of labelled equipment and the accrued labelling fee due for each quarter within the following month of the close of each quarter of the financial year;

(g) furnish to the Bureau an updated list of authorised distributors, dealers, retailers, sellers appointed to sell their labelled products by 30th day of April of each year; and

(h) comply with such other terms and conditions which the Bureau may specify including those contained in the Bureau’s Manual on Standard and Labelling.

9. Label fee. - (1) Every permittee shall pay to the Bureau a label fee of rupees thirty for each label affixed on the washing machine.

(2) The label fee specified under sub-regulation (1) shall be paid annually within one month from the date of

closure of each financial year:

Provided that on failure to pay the label fee within the period so specified, the Bureau shall recover the amount due with interest thereon at ten percent per annum from the label security deposit paid made under clause

(b) of sub-regulation (3) of regulation 6, and if complete labelling fees are not recovered within one year of the last date of submission, the Bureau may cancel the permission to labels granted to the permittee and publish the name of the permittee in the national or regional daily newspapers and in electronic means as a defaulter.

10. Refund of label security fee. -- Subject to the provisions of sub-regulation (2) of regulation 9, a permittee shall be entitled to a refund of the label security deposit, on ceasing to manufacture washing machine.

11. Verification by Bureau. - (1) The Bureau or its designated agency may, either suo motu, or on a complaint received by it and carry out verification to ensure that the washing machine conforms to the star level and other particulars displayed on its label and it complies with the other terms and conditions of permission.

(2) All test includes wash performance, rinse performance, energy consumption, water consumption and water extraction performance (residual water content).

(3) For the purpose of verification, samples shall be picked up at random by Bureau or its designated agency from the manufacturing facility and warehouse or the retail outlet as it deems fit.

(4) Where, upon a complaint received under sub-regulation (1), the Bureau is required to carry out verification by challenge testing the washing machine in an independent laboratory duly accredited by National Accreditation Board for Testing and Calibration Laboratories,-[भाग III—खण् ड 4] भारत का रािपत्र : असाधारण 31

(a) the Bureau shall issue a notice to the permittee in form V for carrying out such testing and the complainant shall be called upon to deposit, such expenses relating to sample cost, testing, transportation and other incidental expenses with the Bureau, within such time, as may be determined by Bureau.

(b) if the sample drawn under challenge testing fails, all expenses towards the cost of sample, transportation of sample and the testing charges, shall be reimbursed by the permittee to the Bureau and the Bureau shall refund the aforesaid expenses to the complainant; and

(c) where the equipment passes the challenge test, then, the expenses deposited by the complainant shall be forfeited.

(5) Where, upon a complaint received under sub-regulation (1), if the permittee fails to deposit such expense referred to in sub-regulation (3) within such time, the Bureau shall -

(a) continue the verification by challenge testing the washing machine referred to in sub-regulation (3); and

(b) the processing of application received under regulation 6 may be kept in abeyance till such expense are deposited.

(6) Where samples of washing machine used for testing fails the test during suo motu testing or challenge testing, the Bureau shall offer the permittee, another opportunity and conduct a second test with twice the quantity of washing machine used in the first test, in an independent test laboratory which is different from the lab where the first check testing was conducted and shall be duly accredited by National Accreditation Board for Testing and Calibration Laboratories at the cost of the permittee and the Bureau shall intimate the permittee in Form V to witness the challenge testing referred to in sub-regulation (3) or the second test referred to in sub-regulation (4) and the expenses to be made towards the procurement and testing of sample..

(7) Where the second test fails, the Bureau shall, -

(a) direct the permittee in Form VI, under intimation to all the State Designated Agencies, that the permittee within a period of two months shall,-

(i) correct the star level displayed on the label of the washing machine or remove the defects and deficiencies found during testing;

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material;

(b) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specifications in any national or regional daily newspaper and in any electronic means or in any other manner as it deems fit, within two months;

(c) Intimate to the concerned State Designated Agency to initiate adjudication proceedings against the permittee and the trader under section 27 of the Act.

(8) The permittee shall within ten days of the conclusion of the period of two months referred to in sub-regulation (7),-

(a) send the compliance report in Form VII to Bureau with respect to action taken in compliance with the direction; and

(b) in case the compliance report referred to in clause (a) is not received or received without complying to any of the direction within the specified period, it shall be deemed as non-compliance of the direction issued and orders to that effect shall be passed by the Bureau.

(9) The Bureau shall send a copy of the compliance report referred to in clause (a) and orders passed in clause

(b) of sub-regulation (8) along with necessary documents to all the State Designated Agencies for the purpose of taking action under section 17 of the Act and enforcement of the orders passed under clause (b) of the said sub-regulation.

(10) Where the permittee fails to comply with the directions issued by the Bureau under sub-regulation (7), the Bureau under intimation to all State Designated Agencies, shall,-

(a) withdraw the permission granted to the permittee under sub-regulation (1) of regulation 7;

(b) send report to the Central Government accompanied by the test report in support of the failure by the permittee to conform to the energy performance standards notified by the Central Government under clause

(a) of section 14 of the Act and the directions of the Bureau referred to in clause (a) of sub-regulation (8) for consideration and taking action under clause (c) of section 14 of the Act by the Central Government;32 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(c) publish for the benefit of the consumers, the name of any permittee, brand name, model name or model number, logo and other specification in any national or regional daily newspaper and in any electronic or in any other manner as it deems fit within two months; and

(d) intimate to the concerned State Designated Agencies to initiate further adjudication proceedings against the permittee and the trader under section 27 of the Act.

12. Cancellation of permission.-The Bureau shall cancel the permission granted under regulation 7, if the permittee –

(a) fails to comply with any of the terms and conditions specified under regulation 8;

(b) fails to pay label fee within the period specified under regulation 9;

(c) does not comply with the direction issued under regulation 11.

(g) the permittee shall make available such other details of washing machine as and when sought by the Bureau for which the permission has been granted.

Now, therefore in pursuance of the provisions of sub-regulation (1) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Washing Machine) Regulations 2023, the Bureau is conducting suo motu test/challenge test (as applicable) on ……..(date) at …………(Name of laboratory), accredited by National Accreditation Board for Testing and Calibration Laboratories.

5. Pursuant to the provisions of sub-regulation (6) of regulation 11of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Washing Machine Regulations 2023, the Bureau hereby intimates to -

(i) nominate an official to witness challenge test or second test on the above date specified along with an authorization letter indicating (in original) the name, designation and signature of the nominated official (the letter shall be duly signed and stamped by authorised signatory of the company).

(ii) deposit such cost towards procurement, transportation, testing and other incidental expenses as mentioned in Annexure, within fifteen days from the date of issuance of this letter (the expenses shall be deposited through electronic mode).

6. You may note that the Bureau shall continue the verification by challenge test or second test, even if the aforementioned expenses are not made in time or the officials are not nominated as specified and shall take further follow up action in the matter in terms of sub-regulation (7) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Label of Washing Machine) Regulations 2023.

3. The Bureau through its aforesaid Verification Agency had transported the sample referred to in para 2 to M/s. ..................., a National Accreditation Board for Testing and Calibration Laboratories accredited laboratory for conducting tests in accordance with the test procedure indicated in paragraphs 4 and 5 of S.O.number ……dated the …. for giving Test Report in accordance with the Form ….given in Annexure to S.O.. number…….. dated the ……..

4. The results of the Test Report on the sample bearing Unique Identification serial number is enclosed. The results of the Test Report indicated that the sampled washing machine failed to meet the energy consumption test. and did not conform to the Test details furnished by you in Form 1 annexed to the Application submitted by you for seeking permission to affix label on the washing machine manufactured or imported by you. The Test Results were sent to you vide Bureau of Energy Efficiency letter No... ..... dated........in the name of your authorised Contact person. You were also requested to attend and witness the Second Check Verification Test of the samples at the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory M/s....................................................

5.The Sample for second check verification Test were picked up …. dated the …. through our authorised Agency M/s. ............and transported to the National Accreditation Board for Testing and Calibration Laboratories accredited Laboratory transported by our authorised Agency, duly sealed by M/s............... and was given Unique Identification serial number embossed on the said sample obtained from ............... ..........under signatures of the duly authorised representative of the verification Agency as well as your representatives.

6. The Test results of second check testing are enclosed which are dully checked and counter signed by the competent authorised personnel of the National Accreditation Board for Testing and Calibration Laboratories Accredited Laboratory. The test report is also duly signed by your authorised signatory as witness of 2nd check testing. The Test Results confirm that they failed to meet the requisite parameters and standards given in S.O.number …. dated, …. and the terms and conditions of the permission given to you for display of particulars on label affixed to the Washing Machine manufactured or imported and sold in the market .

7. Now, therefore in exercise of the power conferred clause (a) of sub-regulation (7 ) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulations, 2023, the

Bureau hereby directs to :-

(i) correct the star level displayed on the label of the washing machine or remove the defects and deficiencies found during testing;48 THE GAZETTE OF INDIA : EXTRAORDINARY [PART III—SEC.4]

(ii) withdraw all the stocks from the market to comply with the directions of the Bureau; and

(iii) change the particulars displayed on advertising material.

8. You are hereby directed to complete the aforesaid corrective action within two months from the date of issue of this letter and send the compliance report in Form VI within ten days after the expiry of two months i.e. by ..............

.In case no compliance report is received by the said date the Bureau shall proceed to take action in terms of clause (b) of sub-regulation (10) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulations, 2023.

9. The Bureau shall take further follow up action in matter in terms of regulation (5), (6),(7) and (8) of regulation 11 of the Bureau of Energy Efficiency (Particulars and Manner of their Display on Labels of Washing Machine) Regulation, 2023.
